1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Weightsmith" / "We" / "Us" / "Our" refers to the business operating under the name Weightsmith, registered and operating from 4 Jalan Merdeka Raya, 75000 Melaka, Malaysia.
• "Track" refers to any of the three online AI development programmes offered by Weightsmith: Cold Start, Hot Work and Tempering.
• "Participant" / "You" refers to any individual who enrols in or enquires about a Track.
• "Cohort" refers to the group of Participants enrolled in the same Track during the same period.
• "Materials" refers to all course content, recordings, exercises, assessments, feedback and resources provided as part of a Track.
• "Agreement" refers to these Terms and Conditions and any enrolment confirmation issued by Weightsmith.

2. Acceptance of Terms

By submitting an enrolment enquiry, making payment, or accessing any Track materials, you confirm that you have read, understood and agree to be bound by this Agreement.

You must be at least 18 years of age to enrol in a Track. By agreeing to these terms, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement.

If you are accessing or using our services on behalf of an organisation, you represent that you have authority to bind that organisation to this Agreement.

3. Service Description

Weightsmith provides three online AI development tracks delivered to cohorts of participants. Tracks are delivered via online platforms, including live video sessions, recorded materials, cohort communication channels and written feedback on assessments. No compulsory in-person attendance is required.

Track content, schedules and inclusions are described on our website at the time of enrolment. We reserve the right to make reasonable adjustments to session timing, platform tools and supplementary materials during a running cohort, provided the core curriculum and assessment structure remain substantially unchanged.

Tracks are open to participants in Malaysia and internationally, subject to platform availability. We do not impose geographic restrictions beyond what is required by applicable law.

4. Enrolment and Account Access

Enrolment is confirmed upon receipt of full payment and a written confirmation from Weightsmith. Access to Track materials is provided at or before the cohort start date.

You are responsible for maintaining the security of any account credentials provided for Track access. You must not share access with third parties. Weightsmith is not liable for losses resulting from unauthorised access due to your failure to protect credentials.

If we discover that access is being shared with individuals who have not enrolled, we may terminate access without refund.

5. Participant Responsibilities

As a Participant, you agree to:

• Engage with Track content and assessments through your own work and effort.
• Conduct yourself respectfully in cohort channels and live sessions.
• Not reproduce, distribute or publish Track materials without written permission from Weightsmith.
• Not use Track resources or channels for purposes unrelated to the programme.
• Not submit work that is not your own as your assessment submissions.

Breaches of participant responsibilities may result in removal from the cohort without refund.

6. Intellectual Property

All Track materials — including but not limited to recorded sessions, written exercises, assessment rubrics, feedback templates and course documentation — are the intellectual property of Weightsmith. Enrolment grants you a limited, non-exclusive, non-transferable licence to access and use materials for your personal study during the Track period and for a period of twelve months after the Track ends.

Work you produce as part of assessments and the capstone project remains your intellectual property. By submitting work for assessment, you grant Weightsmith a limited licence to review, comment on and store that work for the purposes of providing feedback and issuing your completion record.

7. Fees and Payment

Track fees are stated in Malaysian Ringgit (RM). Cold Start is RM 465. Hot Work is RM 1,880. Tempering is RM 4,070. Fees are payable before the cohort opens. Payment methods accepted are confirmed at the enquiry stage.

Instalment arrangements for longer tracks may be available on request. Any instalment arrangement must be confirmed in writing by Weightsmith before it is valid. Failure to complete an instalment schedule may result in suspension of access.

Cancellation and Refunds

• Cancellation with full refund: more than 14 days before the cohort start date.
• Cancellation with 50% refund: 7 to 14 days before the cohort start date.
• No refund: less than 7 days before the start date or after the cohort has begun.
• If Weightsmith cancels a cohort before it starts, a full refund will be issued.

8. Completion Records

A written record of course completion will be issued to Participants who have submitted all required assessments and whose account is in good standing at the end of the Track. Records state the track name, content covered, hours logged and assessment outcomes.

Completion records are descriptive documents issued by Weightsmith. They are not academic qualifications, professional licences or accreditations. Weightsmith makes no representation about how third parties — including employers — will regard these records.

9. Disclaimers

Track materials and instruction are provided to inform and develop practical skills. Weightsmith does not represent that completing a Track will result in employment, income, career advancement or any specific professional outcome. Individual results depend on prior background, effort, external market conditions and other factors outside our control.

Materials are provided in the condition available at the time of each cohort. We update content between cohorts but do not warrant that all third-party tools, libraries or platforms referenced in exercises will remain available or function identically throughout the Track period.

10. Limitation of Liability

To the extent permitted by Malaysian law, Weightsmith's total liability to you in connection with a Track shall not exceed the fee paid by you for that Track.

Weightsmith is not liable for indirect, incidental, consequential or punitive damages, including but not limited to loss of income, loss of data or loss of business opportunity, arising from your use of or inability to use Track materials or services.

11. Indemnification

You agree to indemnify and hold harmless Weightsmith, its staff and affiliates from any claims, damages, costs or expenses arising from your breach of this Agreement, your misuse of Track materials, or your violation of applicable law.

12. Termination

Weightsmith may suspend or terminate your access to a Track if you breach these Terms, share access credentials, submit work that is not your own, or engage in conduct that disrupts the cohort experience for other Participants. Termination for cause does not entitle you to a refund.

You may withdraw from a Track at any time. Refunds are subject to the schedule set out in Section 7. Upon termination or withdrawal, your licence to Track materials ends.

13. Dispute Resolution

This Agreement is governed by the laws of Malaysia. Disputes will be subject to the non-exclusive jurisdiction of the courts of Melaka, Malaysia.

Before initiating formal proceedings, both parties agree to attempt informal resolution by contacting [email protected] and allowing 30 days for a response and negotiation period. This requirement does not prevent either party from seeking urgent injunctive relief.

14. General Provisions

• Entire Agreement: This Agreement constitutes the entire agreement between you and Weightsmith regarding your enrolment and supersedes any prior representations or understandings.
• Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce any provision of this Agreement does not constitute a waiver of future enforcement of that provision.
• Assignment: You may not assign your rights under this Agreement without our written consent. Weightsmith may assign or transfer its rights in connection with a business transfer.
• Notices: Notices from Weightsmith to you will be sent to the email address provided at enrolment. Notices from you to Weightsmith should be sent to [email protected].

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to enrolled Participants by email at least 14 days before taking effect. For changes that take effect during a running cohort, we will seek written acknowledgement from affected Participants. Continued participation in a Track after the effective date of updated terms constitutes acceptance.
